Contract for the Supply of Goods or Services

We must receive payment for the total price of the goods that you order before your order can be accepted. Once we have received your payment we will confirm that your order has been accepted by sending you an email to the email address you provided at the time of your order.

This confirmation email amounts to an acceptance by us of your offer to buy goods or services from www.enamelledjewellery.co.uk and this acceptance is effective regardless of whether or not you receive the email. Our acceptance of your order brings about a legally binding contract between us. We are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself.

Availability of Goods

  1. All goods advertised for sale on our site are subject to availability. If an item is out of stock an cannot be supplied within normal delivery times we will inform you by email or telephone of the anticipated delay.
  2. We will no charge you for goods we cannot supply. However we will not be responsible for any damage or losses that you may suffer if we fail to supply goods.
  3. We have displayed the jewellery and other handcrafted articles on the site as accurately as possible, however as all items are individually handmade slight variations in colour or design are to be expected. Images of products show examples of the product and are not necessarily an image of the actual item supplied. The colours shown on your monitor may also vary a little from the colour of the original jewellery, or other handmade articles. You should therefore not expect an exact colour match with for instance, other items of jewellery or an outfit you may have, based on these reproductions. Orders can only be taken on the understanding that the buyer fully appreciates that this is the case.

Prices

The prices payable for goods that you order from us online are set out in our website and are correct at the time of display. However we reserve the right to alter prices from time to time without notice. However we will of course, once we have accepted an order at a certain price, not change the price that applies to that order. We make every effort to maintain prices, but these may be subject to variations caused by factors beyond our control.

Cancellation by you 

We hope that you will be completely happy with you purchase. However should you wish you may do so at any time up to the seventh working day from the day you receive the ordered goods. You do not have to give any reason for cancelling your contract with us (although it would help us to know) nor will you have to pay any penalty. To cancel your contract you must notify us in writing to our postal or email address. Any phone cancellations must be confirmed in writing within the permitted cancellation period. If you have received the goods before you cancel the contract then you must send the goods back to us at our postal address at your own cost and risk. if you cancel your contract but, we have already processed the goods for delivery you must not unpack the goods when you receive them, and you must send back the goods to us at our postal address at your own cost and risk as soon as possible.

Exclusions: No items made specifically to a design provided by, or commissioned by you, or personalised at your request should be returned, as no refunds can be give in this case without good reason, such as defective parts, or if the goods are found to fall below our usual high standards of craftsmanship.

Once you have notified us that you are cancelling your contract any sum debited to us from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order date, provided that the goods in question are returned in the condition they were in when they were delivered to you.

Cancellation by us

We reserve the right to cancel the contract between us if:

  • We have insufficient stock to deliver the goods you have ordered.
  • We do not deliver in your area.
  • One or more of the goods was listed at an incorrect price due to a typographical error. 

If we do cancel your order we will notify you by email and will re-credit your account any sum deducted by us from your credit/debit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer additional compensation for disappointment suffered.

Customer Obligations

By placing an order you confirm that you agree to use your correct name, address and date of birth and to supply any other details reasonably requested to process your order.

Payment Information

This site has full SSL security. We accept payment through payment processing companies Stripe and Paypal (You do not need a Paypal account to use this option) using the credit/debit cards identified on this site. Payments are processed securely by the two companies in the following way:

  • Stripe payments take place on our site - https:/ www.enamelledjewellery.co.uk.
  • Paypal payments are made by temporarily transferring you to their website, before returning you to our site.

We do not have access to your credit/debit card details at any time.

Credit/debit and charge card payments are subject to validation and authorisation by the card issuer and we will not be liable for any non- delivery or delay if a card issuer refuses to authorise payment.

Transmission of your debit/credit card number and other detailsin relation to payment in relation to payment will be at your own risk. We cannot accept responsibility or liability for failures in transmission or information deletion, non-delivery or, failure to store any communications by you.

Liability

If the goods that we deliver are:

  • not what you ordered
  • damaged
  • defective
  • of incorrect quantity

we shall have no liability to you unless you notify us in writing of the problem within 10 working days of delivery of the goods in question by email or to our postal address. If you do not receive the goods you ordered within 30 days of the date you ordered them we shall have no liability to you unless you notify us in writing of the problem within 40 days of the date goods were ordered by writing to us at our postal or email address.

If you notify us of a problem under either of the previous conditions our sole and exclusive obligation will be at your option:

  1. to make good any shortage or non-delivery, or
  2. to replace or repair any goods that are damaged or defective, or
  3. to refund you the amount paid by you for the goods in question in whatever way we choose.

Nothing in these terms and conditions is to be taken to exclude, or restrict rights granted to you by law in respect of goods supplied.

 We do not accept responsibility for damage to goods caused by you.

  • We will not be liable to any person for damage or loss arising from the use of goods advertised on our site. 
  • Withiut prejudice to your statutory rights the information contained in this website is provided without warranty and in particular we do not represent or warrant that the information is accurate, complete or current, or that the use of this site will be uninterrupted or error free.
  • We will not be responsible for claims relating to the availability of our range, our Ecommerce engine, our website, place of purchase or, success or level of sales resulting from these.

Dispatch of Goods

  • We will deliver the goods to the address which you have given us at the time you made your purchase.
  • Delivery will be made as soon as possible after your order. We will endeavour to ensure that the goods are delivered by any delivery date estimated by us, but we cannot guarantee that goods will be delivered by that date. You agree that we will not be liable to you for any loss, damage, or  charge incurred because of the late delivery of goods.
  • Once the goods have been delivered to you, they will be held at your own risk and we will not be responsible for their loss or destruction.

Returns

  • If you are not completely satisfied with your purchase, you can return it within 14 days after receipt, in its original 'unworn condition' and we will refund the product price or exchange it for another product. 
  • Your postage costs to return an order, nor the original postage charges will be included in a refund.
  • Your satutory rights as a consumer are not affected.

General

Notices served under these terms and conditions must be in writing and will be deemed to be given when:

  • Personally delivered,
  • Sent by confirmed email, or
  • Three days after being sent by mail requiring a signature  to the address set out in our dispatch note.

Any failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of those terms and conditions. 
These terms and conditions may be subject to change at any time without prior notice to you.

These terms and conditions shall be governed by and construed in accordance with English Law.

Events beyond our Control

We shall have no liability to you for any failure to deliver any goods that you have ordered, or any delay in doing so, or any damage or defect to goods delivered that is caused by an event, or circumstances beyond our reasonable control, including without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any of these Conditions (or part of these Conditions) is unenforceable (including any provision in which we exclude our liability to you) the enforceability of the remaining Conditions (or remaining part of any Condition) will not be affected .

Third Party Rights

Notwithstanding any other provision of the contract between us, nothing in the contract between us confer, or purports to confer any right to enforce any of its terms on any person who is not a party to it.

Entire Agreement

These Conditions, together with our current website prices, delivery details and privacy policy set out the whole of our contract relating to the supply of goods to you by us.

Disclaimer

We accept no responsimilitude for injury caused by destruction, misuse, neglect, or negligent supervision of our products.

Jurisdiction

Any contracts & agreements formed between you you & us by means of this website shall be governed & construed by English Law & any disputes, or proceedings shall be subject to the exclusive jurisdiction of the English Courts.

Intellectual Property Rights

The material on this site is protected by copyright.
